P1, women’s experience in colonial America under civil law or common law. Their right, and power were limited under common law. Comparison shows two different colonial regimes, that women get more benefits from civil law.
P2. New Mexico — Spanish law, NY — civil law giving way to common law
P3. During marriage, women control her own property, her husband cannot sell it. The woman has the right to dispose the property without the husband’s consent. If the man die, the women continue to control the property and also get control of the dowry and the arras and half of the community property. The other half is to be divided by the man’s child.
