As I understand, in this question, ETS tries to confuse us by using "that" and the following to make it look like a subordinate sentence that modifies "imprisonment". If we buy it, then ETS suceesfully tricks us.
However, if you give it a second thought, You will notify how awkward this sentence is. "If" would be appropriate to replace "that" here because the subordiate sentence states a condition that will lead to imprisonment.
