Because it's a doctrine, "making" is more favorable than "that makes".

Now we have a & d left. In a, "that" discribes imprisonment --- logically inconsistent. imprisonment is a consequence, but "a U.S. citizen hold ....." is an action. You can say that the action LEADS TO the consequence, but you cannot say the action is the same as the consequence.

As I understand, in this question, ETS tries to confuse us by using "that" and the following to make it look like a subordinate sentence that modifies "imprisonment". If we buy it, then ETS suceesfully tricks us.

However, if you give it a second thought, You will notify how awkward this sentence is. "If" would be appropriate to replace "that" here because the subordiate sentence states a condition that will lead to imprisonment.

第二个that是不是可以理解为同位语修饰a crime？但a United States citizen hold的单复的确错了；另外that makes的时态与后面found不配。

但D的because of的语气和整句表达的内容总不太顺畅，在短时间内作题，还是很容易选成B的。（看来对个别题目大可不必太认真了：）

同意，这题思路较怪，有旁门左道之嫌，与ets思路似乎偏差较大，不宜仔细研究，点到即可，想多了反而影响正常的做题思路！
