为什么选A不选E?

because of 后面接名词，名词短语。两个its不简洁。 to its customers of keeping
也不简洁，直接to keep

感觉是通过某种手段更合适一些吧

为什么选A不选E?

我是这么感觉的：
首先，原文中使用的是By 所以是表示手段的，而且表达通顺，因此不要改变句子的逻辑关系，因此还是选用by.
而 E成了因果关系，因此就改变了原文的意思。

另外，即使觉得AE都可以，再通过动词简洁的原则。by failing 这里是动名词，有动作含义，而its failure 名词。
而且because of 中后面修饰成分复杂，代词its出现两次（重复，没必要），因此怎么看还是A简洁。

另外我自己感觉大方向没错的话，我感觉如果to do 可以的话，就不要用of doing.
语法笔记还提到一点 : promise to do / that 是固定搭配，其他不可以

我觉得你的解释过于笼统了
再深入问一句
那为什么我们会误以为by doing 修饰的是律师呢？我一开始读的时候也觉得应该修饰attorney，但是读不懂
这是否意味着A选项的By doing就有修饰歧义了呢？
但是OG里没有说这里存在歧义，也就是说OG认为by doing语法上修饰engage是完全正确的
也就是说by doing作为状语是修饰就近的动词的，而不是跳跃修饰attorney的动作accuse

我觉得你的解释过于笼统了

但你到底要问的是什么啊？？这里的就是修饰ENGAGE........那个啊。
楼主要不你先把意思理解一下吧，如果BY修饰的是ATTORNEY,这个意思就很突兀了。
bank of engaging in deceptive business practices,前面明明说了人家没犯法，无端端说ACCUSED，你总得解释个原因吧。BY就是原因。不知道你懂了没？
