In one state, all cities and most towns have antismoking ordinances.  A petition entitled “Petition for Statewide Smoking Restriction” is being circulated to voters by campaign workers who ask only, “Do you want to sign a petition for statewide smoking restriction?”  The petition advocates a state law banning smoking in most retail establishments and in government offices that are open to the public.


Which of the following circumstances would make the petition as circulated misleading to voters who understand the proposal as extending the local ordinances statewide?

C The state law would supersede the local antismoking ordinances, which contain stronger bans than the state law does.
E   The state law would not affect existing local ordinances banning smoking in places where the fire authorities have determined that smoking would constitute a fire hazard.

题目问那个误导了那些把州法看成地方法的延伸的voter 。c说州法比地方法更加严厉这就是说州法更加完善是支持“州法为地方法的延伸 ”这一观点。 偶就奇怪了你么怎么都选c? 我分析两次就觉得c是支持。


e说在某些地方州法不能和地方法一样的管到。 削弱了“州法为地方法的延伸” 偶还以为这道题很简单,没想到和大家的都不一样。

麻雀弟弟,我认为是E,但是不太理解你的解释。C是说州法凌驾于地方法之上,所以州法不是地方法的EXTEND,不会误导选民。而E说州法不会管现在已经有的某项法令,所以才会误导选民。唉,这道题我也很晕,请牛牛们指教。

这一题的推理逻辑:

主要要理解什么叫misleading, 这里misleading 的结果不是voters understand the proposal as extending the local ordinances statewide, 相反:misleading 的结果是:对于petition 所提出的问题 "Do you want to sign a petition for statewide smoking restriction?" 原来会回答yes的人现在有可能回答no 了.

对于 do you want to sign a petition for statewide smoking restriction 这个问题, campaign workers 原来指望的是因为all cities and most towns have antismoking ordinances - 绝大部分的voters 会同意这个petition - i.e. say 'yes' to the petition question, 但是因为两个原因,造成有些人会被misleading而不同意这个petition:

原因一:这个问题(do you want to sign a petition for statewide smoking restriction? )本身问的不清楚,造成有些voter 理解这个问题为:extending the local ordinances statewide,

原因二:如选项C所述,The state law would supersede the local antismoking ordinances, which contain stronger bans than the state law does. 注意这里选项都是"circumstances" - 因为州法会取代地方法,所以选民会想:如果我同意这个petition, 会造成原来严厉的地方法被温和的州法所取代,造成禁烟失败,所以对于petition 的问题,这些选民会选择回答NO, 这才是misleading 的真正意思所在。

此题有一个很明显的Assumption是:因为all cities and most towns have antismoking ordinances,所以绝大部分的voter 是支持禁烟的。在一个民主国家可以获得通过的ordiance必然是取得了大部分voter 支持的。
