Rules are always rules, if you can break rules easily then why are they there? Yes you can modify rules and laws but before doing that you MUST follow them rigorously. One reason why China government is losing its creditablities is the fact that our laws allowed too many overrides under the names of "humanity" or "special situation".
The rule says you must ensure the delivery of all materials by the deadline so you are at your own risk by not allowing sufficient time for it. ETS is out of control of Kellogg and Kellogg has no way to verify if it's true that ETS system broke down. In this case do you think it is fair to ask Kellogg to do ETS a favor by interrupting their own process order? Take a simpler example, I reported to work late this morning because the bus I took broke down in the middle of its way, of course I can explain the situation to my boss and ask for his understanding, but he's definitely right to say, "it's the business between you and bus company".
The attitude is cold, which makes you, me as well, not comfortable, they should at least recommend some alternatives. But if I were you I will suggest the alternatives by myself in this case. I will submit a photocopy of my score report and the letter from ETS to prove the effort I've taken to meet their requirements, I will also call ETS to complain about their delay (anyway, considering the xmas holiday it's quite acceptable for Americans) and ask for assistance.
Think more, do more, and murmur less, you will find this world better, cheers.
