这篇文章我做的时候也是稀里糊涂,但是这个题做对了,参考答案之后精读了全文,终于明白Gmat想考我们什么。以下是我的理解,仅供参考。
这道题需要对文章的整体理解,第一段讲印第安用水权的问题及winters这个法案的产生,并且表明了三种情况下该地的用水权可以保留。到第二段就是一个转折,一些印第安部落通过传统方式(而非现有法律)来决定用水权。下面的supporting ideas就开始讲Pueblo部落的问题了。他们在美国取得新墨西哥州的统治权之前就已经存在那里,而在隶属美国之后,政府一直也没有把其划归为public lands,自然也没有撤销过public lands,所以不符合第一段中的那三点要求。然而就现实来说,由于他们一直被默认为reservations,所以pragmatic approach 就是承认他们reservations的位置,给予他们响应的water rights。因为it is a question of practice,not of legal definition.所以正确答案是A。
再看B,这个pragmatic approach是特指,往前看可以知道,它是针对于reservation的,而非water rights,更没有提到通过用水历史来决定用水权,这是后面的内容,所以这个答案过于宽泛,不合适。
C选项与第二段的内容无关。D没有提到。E与事实相反。
