One, dated May 3, 1739, is a record of Schnitzler’s arrest for peddling without a license. The second, undated, is a statement by Schnitzler asserting that he has been peddling off and on for 20 years.

C: the undated document was written before 1765.

The first document indicates that S started pedding without a license at least before 1739 and the second document says that :"S has been pedding without a license for 20 years"."Has been"means S was doing this on that date.  Obviously, the second document dated bo later than 1759.

So C is right.
