求助:MBA在读以本科生身份申请H1BVISA

我现在是MBA最后一学期,已经拿到OFFER.现在给我OFFER的公司四月会为我申请H1B VISA,因为我是五月份才毕业拿到MBA的MASTER学位,四月时我只能用BACHELOR的身份申请.我现在的疑问是,鉴于去年申请的情况,如果我用BACHELOR的身份申请失败了,我是只能明年再用MASTER的身份申请,还是五月份拿到MASTER马上就可以再以MASTER的身份申请了?我记得之前论坛上有说过这个话题,但不是记得很清楚具体的内容了.请知情的大虾指点!

you can file another petition for advanced degree once you get the certificate letter from your school that your credits have been fulfilled. No need to wait till official graduation. If you are lucky, you can get in line before the advanced quota run out

Thanks delphine... I talked with the HR officer and she told me it's highly possible the advanced quota would run out before May, so in any case I cant file in the cap this year, the company would file petition for me again as a master next year.

Really uncertain about the situation this year. Now I'm considering if I should leave one class to summer, so that I will graduate in July, and there would be no gap between OPT and H1-B if I need fill petition again next year.

It can depend on your school's final exam date and graduation date. If the term ends before end of April, once you take the exam, let the professor send a note to academic office and they can provide a certificate for you to prove that all your credits have been fulfilled. But if your school has a late graduation date such as May or June, then you probably have no time. The best way would be taking more classes than your peers do in the previous terms so when the final term comes you've already fulfilled the credits.

You can finish your courses early and apply for both your general and Master’s cap H-1B on April 1^st.  However, there's risk related to this strategy. One interpretation of immigration policy indicates that you would then need to begin your twelve months of OPT employment within 60 days of completing your requirements.  Thus, OPT would have to begin in late May or early June.  OPT would therefore end in May or June of the next year.  If you are not successful in obtaining an H-1B in the lottery, you would face a potential 5 - 6 month visa gap the next year rather than the customary 3 month gap common with the normal process (“normal process” = OPT beginning in July).  Thus, your gamble in finishing early would work against you if you fail to get a visa this cycle, because it widens the gap in your employment the following year.
