题目的意思是：“关于私人拥有的企业里，吸烟者和不吸烟者需有分开的指定的区域”这样的立法是不该justified，这根本不关不吸烟者是否会因为烟而harm的问题，而是而是政府对私人企业所拥有权力的一种妨碍。答案是与这个逻辑一样的principle：

A 当个人受到伤害时，政府对私有企业的侵入是合法的（与原文相悖）
B 个人呼吸安全空气的权力超过了企业不受政府干预的权力（也是与原文相反，否则文中的立法应该合法化）
C 企业自决权力高于政府保护民众的任何权力和义务（明确指出了政府不该干涉企业，与原文一致）
D 保护员工在上班的地方不受伤害是企业的义务（未提到政府，无关）
E 企业权力和政府责任冲突的时候，主要办法是相互妥协
