绝大部分的H1B都是要占名额的。目前我知道的不需要占名额的H1B就只有non-profit org. sponsor的H1B。

如果不放心，就和公司HR确认吧。

如果现有H1B是不占名额的，我的理解是一旦恢复到F1，这个H1B就永久消失了。等到MBA毕业要申请新的H1B的时候，程序会和所有大部分普通H1B一样，4/1递交pentition，10/1生效。 如果在此之前有OPT过渡，身份就没问题。但是4/1 file pentition的时候，学生并没有毕业。在没有毕业证书的情况下，这时候只能用已有学位来file。对于之前只有本科学位的人，就会面临和本科生一起抽签；而对于之前在美国取得master学位并且已经用掉master degree的OPT的人，则要面临在毕业前找到工作的压力。

以上是我的理解，要是有错请指正。身分转换很重要，要是误导了任何人就不好了。今年美国大选，到时候移民法也会有大变动。所以未来的形势现在也很难说。

And after MBA graduation, you can either use OPT or directly use H-1. When the time comes, I think I would use OPT first, because you are waived from med-care and social security tax, which will save us over 10k, based on average first year MBA salary.

As for the quota, I do not think we will have to enter the lottery, if you first got your H1 from the lottery.

Please correct me if I am wrong. I completely agree that it is very important to correctly understand the process.

I didn't know that there are H1b visas that are NOT subject to the quota. Can you please explain?

so if I got my visa as a winner of last year's H1b lottery, that means it is subject to the quota, right?
