I am pretty sure that u r wron gin this point. u can consult any lawyer. Im pretty sure f1 students can build up their own companies. The company also can sponsor their own or others' eb1, eb2. I have these kinds of frnds. I also wanna set up one last year. It wont take that much trouble. If u really wanna know, u can ask any lawyers.

Here is what I hear from some lawyers that makes
most sense to me (even most immigration lawyers do not know this very well,
surprisingly, so make sure that you call around):
1. F-1/H1 can start your own certain types of corporation. there are some
restrictions, though, for example, you cannot start a S-Corp which is perhaps
the best in terms of tax.
2. Very important! You cannot work for your own company. You can only be the
owner and have someone else who has work authorization to do all the work for
you. You can derive income from the profits made by your company as a
shareholder, but you cannot draw yourself a check as salary. In short, you can
ONLY earn money PASSIVELY, unless you have work authorization, which is
discussed below:
3. Your com can apply H-1b for yourself through your company. But I don't know
how likely it's going to be approved for a start-up. You CANNOT sponsor green
card for yourself.
Final caution from one immigration attorney. He thinks that although
theoretically F1's can start a company and earn income passively, but it could
cause problem for your green card application - would INS really believes you
never worked for your own company? If you are unlucky you may get picked on.
That's just his suggestion.
