In addition, USCIS has received 18,700 petitions toward the H-1B Master’s exemption cap for FY 2013. Given the pace of filings since the last update from USCIS, we expect that H-1B numbers for FY 2013 will run out later this week or early next week. Because a new H-1B must be filed with a Labor Condition Application (LCA), and because the Department of Labor is taking at least 7 days to certify LCAs, any cases not yet initiated may well be too late to make the cutoff for this year’s cap.
