The speaker claimed that many problems of modern society cannot be solved by laws and the legal system,because that the laws cannot change what is in people's hearts or minds.It maybe tempting to agree with the speaker that the people's heart or minds cannot be changed since the law leading to the malfunction of the legal system.However, the speaker have overlooked several merits of the laws ,according which ,I believe that laws can change what in people's heart or mind ,and the problem in modern society can be solved by the laws and the legal system.
The implicit rationale behind the speaker's statement seems to be that the people's mind or hearts cannot be changed due to the laws.According to the educational function of the law, the mass can be educated through the execution of the laws.From the experience of my own , we are taught that the action of stealing or thief is wrongdoing ,which can be executed by the laws,accordingly ,we would be the citizen to conform to the laws since the awe to the legal system.
When comes to the new problem of the society like the environmental problems, the educational function of the laws can be impressing.We may take China for example.Chinese people would never be such aware of the environmental problems until the wrongdoing of the polluting the rivers or the resident areas are appealed to the court.Due to the magnifying effect of the law suits in the society , the people would be aware of the pollution which are seldom concerned, therefore,the environment problems would be partly solved due to the educational function of the law as well as the legal system.
Even if laws cannot change what is in people's heart or mind,the power of the laws would force the citizens to conform,accordingly, the problems of the society can be wiped out.The case of the food security would be an cogent case.The people in China have witnessed the decline of the morality of merchants in China ,since the merchants would dose some toxic chemicals into our food in order to let the food looks appealing.After the cases are executed by the laws,the illegal merchants are condemned and fined largely by the laws ,they terrified by the social and monetary cost to do so,ending up with being scared to practice again,so the food security problem would be solved .
In final analysis, the speaker have overlooked the merits and characteristics of the laws as well as the legal system.The laws would play an educational role that can change the people's minds or hearts ,and the power of the law can prohibit someone to conduct the wrongdoing due to the heavy cost to ensure the problem can be solved. |
