Law, just and unjust, is a tool to govern a society. People have common sense that he or she, in a society, must obey just laws. While it is not a clear definition or standard of unjust laws, it oversimplifies to resist obeying it.
Just laws, as rational rules and sound regulations, should be obeyed in order to make a safe and stable society. Just laws were examined by long human history, and were verified to be useful of modern society. Just laws against monopoly, for example, to make good economic competitions in societies; just laws resist criminal conduct to safeguard person’s property and security; just laws inhibit race discriminations to guarantee people freedom and equity. Just laws, as coercive power of societies, should also improve individual’s life of education, health, welfare. On the contrary, if it is not just laws to constrain his or her conduct and to assess morality standard, it makes a society dangerous and disordered and cannot safeguard people’s lives. In this event, people have duty to conform just laws.
On the other hand, focusing on unjust laws, it contributes to ‘unjust laws’ definition. Whether citizens have responsibilities to resist unjust law depends on a common definition and evaluation standard of just law and unjust law in a society. If unjust law, that is, is considered as parts individuals’ responsible rights and necessary interests which is confined and deprived by governor or society. People, under this circumstance, should resist obeying unjust laws or disobey without violence. For instance, after the Civil War in history, the back were subjected to race discriminations in ways that he or she could not have meals in a restaurant with the white. In order to resist unjust law and protect his or her right, the back people have a rest in a restaurant without food. They ultimately have the same right as the write, and recently live a harmony life in state. With such definition of unjust law, individuals subjected unfairness and not freedom should disobey unjust law, striving to get his or her necessary right. It benefits as a society to make a stable and harmonious environment.
By monitoring person’s conduct and governing society, unjust laws can be remedied to just ones by disobedience. As is known, an aim of law is to make a peaceful, orderly, safe, stable society. It is undoubted that just law serves to make better society, whereas relative unjust laws have remained short-lived in the long run. The ways in that individuals suffered inequality reject to obey unjust laws also help us to issue just and sound laws over an evolution of human history. Unjust laws are remedied by legislation and judicial constitution through long enduring social problems, ruling out unjust factors of laws. A sound legislative system in recent society has a long history to examine whether it should guarantee every person’s right.
In a conclusion, it is obvious that people have responsibilities to obey just laws. While disobeying unjust laws reflects a social problem that some individuals’ rights are undermined. It pays attention to remedy a more sound law in order to keep a society stable and develop all the time. |
