此题是直接对结论进行反驳的。结论说，小孩子在看待对罪行的惩罚的时候不考虑犯罪人是否有有意的。答案说要知道人是不是故意犯罪需要成熟的心理感觉。小孩子自然不成熟，那么小子自然弄不清哪个是故意哪个是无疑。那么结论也就不成立，因为不是小孩不考虑是否故意而是他们根本看不出来。
