to confine is not acting as a noun here （ but confining could be construed as a noun， the simple gerund）

allow he confine所描述的词不一样，allow是描述motion...confine是描述members of jury. 所以跟go to home是并列关系，因为go to home也是指members of jury. 之所以用be confined,是“被限制在”的意思。整句话的意思是：法官否定了一个提案，（什么提案呢），一个让陪审团人员晚上不用再被限制在旅店了，而是允许他们回家的提案。

instead of 后面要接名词形式，所以A是不对的，E选项中rather than就可以做到前后平行了。
