1) I heard school would help you on loan if you decide to do public interest after law school. You can delay repaying loan for ten years if you are making less than 65K. After ten years, I guess you are off the hook.

2) School like BU ranking around 22, the median salary would be at least 80K-120K.  And a lot of lawyer made good money from Tier3 or even Tier 4 school. And you can always transfer after first year law school if you are not completely satisfied with your school or your ego. I heard several cases of successful transfer after first year. And those are the cases of my friends' friend.  I think it happens more than we know.

3) Pick up a law school where you are going to practice law unless you plan to transfer afterwards. The network you build up in the school matters a lot in job hunting. And usually local schools have advantages over other ones with even higher rank. BTW, I think California is great for practicing IP.

4) Even you don't have a LLB in China, you can for sure take the bar exam in China. And I believe with effort, you can pass it. Thousands of people did that. And thousands of people are still doing it. Don't panic. Don't make a big fuss. You are already a lot better than most of people, Chinese or American, to be able to get into USC. (Congratulations! ) Besides, you have quite unique background. You will be more than fine.

5) I don't agree with you on the language issue. Language will get better with constant usage. For us, with the fluency of both Chinese and English in spoken and writing, it is rather advangtageous than disadvantageous in an era of mankind globalization, in an era with a strong China government.

6) Regarding the patent bar, H1 visa holders can take it but not F1 visa holders. If you are planning to do IP, take it before school start otherwise you will not be able to take it with F1 visa. But you can always do it after law school graduation and with a job with H1 visa.

7) I don't think it is good idea to jump into decision of law school just because of poor job market. Just my opinion. Law school is hard and practicing law will be even harder. On the top of it, we have to borrow a lot money to do it. But if you don't absolutely know this is what you want, you will stuck in something you might not enjoy just for the sake of money.  Life is too short to do that.


谢谢你,Lilac. 我现在也是F1,要下个月才答辩毕业.中间不大可能就几个月给换成H1去考patent bar. 我原来担心是因为mitbbs上曾经有人提到要485什么的, 我没申请过H1,不知道H1approved是不是就有了patent bar需要的那些文件. 不过你说的对,要是条件容许应该在法学院毕业之前就考了,但我现在看来没有办法除非我推迟一年. 没有patent bar在找工作时会有一些劣势,不知道.

加州不错,就是什么都贵,我其实喜欢芝加哥,房子便宜,开车20分钟的近郊就能买到30来万,几年新的4bed house,别的大城市估计都不成,可是就连我呆了6年的UIUC都把我给据了, 感觉特别frustrated. 我老婆还是他们的alumni呢. 还没有想好是BU还是USC, BU便宜点.唉,想起要借这么多钱我就心惊胆战.

说实话,当初想去读法律,部分确实是冲着钱和社会地位去的,另一方面也不想做endless的postdoc,希望我转行的决定以后不会后悔.

The bar exam in China is extreme difficult. I heard that. But it is not impossible. Whoever is able to survive the American Law School can certainly do it. Whoever is able to survive the American graduate school can certainly do it. Whoever is able to survive Chinese graduate school can do it. Whoever survived Chinese college can do it. With effort, everybody can do it.

In the forum of Chinese bar training school, it is showed that there are someone who didn't even go to the usual college did it.

I don't like the idea that you think you are llb so that you can despise others. That's not nice.


恩,我有个高中同学中山医科大学毕业,好像是预防科学,工作不大好找,就去考了个司法资格,现在在做音乐著作权方面的, 05回国的时候看到他,过得满不错的.

建议和一些中国资深律师聊聊, 去看看现在和明天的情况.  拿个案来说问题, 总是危险的. 

以前大专,大专都可以考BAR的.当然,中国一直在限制律师人数,通过率和美国的比起来简直天与地.(10% Vs 60-100%)

有空可以去做做那些考题.



中国人以前赶CS, 现在追MACC, 接下来可能是JD了   (说实话, 读JD 门欗太低了,180所总有一所适合你!),

I think the problem of Tier2 school is that it is hard to borrow money. Another issue is that visa problem. I think the small law firm might not support H1b.  But you can always transfer to another school.  And check for the location. It will be easier for Tier3 school in NYC in job market than even Tier 1 in the middle of nowhere.

读你所谓的TIER 2不是END OF THE WORLD。首先最关键的是地理位置, 还有相关的专业。 如果你有科技背景, 能做IP的话, 现在人难招, 自然会考虑其他学校。

但是你读书的压力会很大, 如果你不能在班上击败美国人, 混入25%, 那前途就有问题了。 当然如果你能进3%, 那完全可以转学T14了。

这个,我觉得楼上俩位有个概念要先澄清下,过了中国司法考试不等于有律所承认的中国法律背景了,这就好象LL.M过了bar还只能做Of Counsel 一样,当然这不是实力问题,纯粹的行业门槛,

btw,我说的是common sense,凡事都有特例的,

我现在的状况是2L, 马上进入3L, 转学已经不可能,即使我是1L,想转学,地理位置好的法学院学费太贵,我是自费,对于没有CO-SIGNER的国际学生,即便我当初的成绩可以达到top14 的标准,也会因经济问题不去读的。

所以在目前消费水准较低的二流法学院就读似乎是我唯一的选择。

问题是,如果我通过纽约的BAR, 是否和当地毕业的普通法学院具有同样竞争力,假设学习成绩相当。

              司法考试:从者众,过者少,取证后路更长


2006年的司法考试报名工作已经于7月20日正式结束。被戏称为“天下第一大考”的司法考试,以其高门槛、高难度、低通过率著称。


    

    然而,从2002年司法考试正式实行以来,参考大军却日渐浩荡。究竟是什么原因吸引了越来越多的人?通过司法考试,是否意味着在法律职业内畅行无阻了呢?今天,让我们走近司法考试一探究竟。


    

考试:路越难行越勇
    


    

    据记者了解,2005年,上海市报名参加司法考试的人数为11043人,通过率为19.56%,考试一次通过率则更低。这也意味着有将近9000名考生没有通过考试。而媒体公布的全国通过率只有14.39%。


    

    同时,司法考试的门槛也在提高。上海市司法考试办公室工作人员介绍说,初设司法考试时,报考学历设定在法律专科以上。而目前的报考条件明确规定,必须是教育部认可的国民教育系列毕业的本科以上学历者。


    

    国家明确的贫困县市可放宽到专科学历,但只针对法律专业的学生;如果是国外、港澳地区的学历文凭,还必须通过“国家教育部留学服务中心国际合作处学历认证”部门的学历认证。


    

    面对这样艰难的考试,众多考生却依然一往无前。从上海市司法考试办公室的统计数据来看,今年报名人数比去年增加了526人,共为11569人,创历史新高。其中不乏已经参加过往年考试的考生。


    

通过:只有资格没有资质
    


    

    司法考试是从事法律职业必须要经过的第一道关。然而挤过独木桥,是否就意味着可以畅通无阻地进入相关行业了呢?答案是:NO!


    

    据记者了解,参加司法考试的考生,在当年年底会接到考试分数单。成绩合格者,可以在次年的2月份左右申领《法律职业资格证书》并办理备案。而这仅仅是代表考生拥有了进入相关职业的资格。考生想要从事这些行业,还需经过其他考核。


    

   
通过司法考试后,考生大致可以从事的相关职业可以分为律师、公证人员、法院和检察院的相关职业、法律服务业这几块。以律师为例,考生在领取《法律职业资格
证书》之后,根据《律师法》规定,需要和律师事务所签订为期一年的实习合同,并在实习期间完成相应的工作和培训内容。期满之后,才可以按照相关规定申请
《律师执业证》。


    

考生:年轻化跨行业


    

    今年上海地区报名参加司法考试的考生中,35岁以下的考生共有10743人,占总人数的92.7%,在校研究生和应届毕业生的报名人数占了总数的30%。


    

   
从考生填写的行业分布数据我们还可以看到,在今年的考生中,政法系统(公安、检察、法院、司法行政、律师、公证、法律服务)和其他国家机关的报考人数为
3491人,占30.1%。而社会其他行业的报考人数则达到了8078人,占了总人数的69.9%,比去年增加了415人。


    

    考生的年轻化为今后整个法律执业队伍的年轻化打下了基础。而社会其他行业对司法考试的关注,也说明了大家对法律的重视。学法的人越多,大众的法律意识就会增强,我国的法制化进程也会加快。 (盛磊岚)
