Yes, you are right.
The problem is not ambiguous modification.
It is wrong-placed modifier.
having-clause cannot modify pollutants but modify the whole preceding clause, because Comma-Ving Pattern.  
However, according the logical meaning, having-clause should modify pollutants.

Thus, it is a wrong placed modifier.
