不是特别明白为啥用虚拟语气，如果A中were改成was还对吗？非常感谢！！！

"...includes a provision for penalties if the deal were not to be concluded“如果交易没有达成，将会受到相应的惩罚。
这只是一种假设，并不希望事实如此，所以用虚拟。即使不用虚拟，至少不应用过去时，而是一般现在时。

首先排除DE，SV agreement...
然后排除B，expected to...
A与C之间的区别就是“is signed that includes”和“be signed by them with”，be signed是虚拟语态（sunjunctive）需要从句才能使用，而且用them指代让人有嫌疑。
所以我选A啦。

A中were改成was不对，条件式（conditional）if+三单+were是定律。
