卡车司机起诉公司要求付加班费,公司说根据法律卡车司机没有加班费。先来看看法律:
The canning, processing, preserving, freezing, drying, marketing, storing, packing for shipment or distribution of:
(1) Agricultural produce;
(2) Meat and fish products; and
(3) Perishable foods.
焦点就在最后一句packing for shipment or distribution of:
公司理解的是:packing for shipment or distribution of,因为这些司机只是distribution,没有packing,所以不qualify加班费。
但是司机一方理解的是:packing for shipment or distribution of,所以不管是packing还是distribution都应该有加班费。
如果当时写法条的人考过GMAT,肯定不会有这个问题,加个逗号就解决了:”The canning, processing, preserving, freezing, drying, marketing, storing, packing for shipment, or distribution of:“
最终法官还是判了:
Since the judge observed that labor laws, when ambiguous, are designed to benefit the laborers, the case was settled.
大意是制定法律是为了保护劳动者的利益,当法律意义模糊的时候,应该站在劳动者的立场上理解。
这个逗号就叫做“Serial comma”或者“Oxford Comma”。但是文章最后,作者还加了一句:
(All of you Oxford comma purists out there, go ahead and gloat. We'll have you know CNN adheres by AP Style, which does not include the mark.)
你们这些Oxford Comma的“脑残粉”就尽情的幸灾乐祸吧,我们会告诉你CNN使用的是AP Style,并不包含“Oxford Comma”。
