94。Judge Bonham denied a motion to allow members of the jury to go home at the end of each day instead of to confine them to a hotel.
对于原句错误原因 ETS的解释是" the passive form to be confined is required. to allow members of the jury ...to confine them illogically indicates that the jurors are doing the confining."
可我为什么觉得画线部分都是修饰 a motion的，所以应该用主动语态，因为是这样一个 motion 把jurors confine在hotel,按照ETS的解释换成被动语态，感觉讲不通阿
请问大家是怎么理解的？

最后正确答案为
"to allow members of the jury to go home at the end of each day rather than be confined to a hotel."

我选的是C “under which members of the jury are allowed to go home at the end of each day instead of confining them in a hotel."

本题纯粹考平行，只有E是平行的.
若to be confined和to allow平行，翻译为：允许陪审团回家而不是限制他们在旅馆
若to be confined和to go home平行，翻译为：允许陪审团成员回家而不是允许他们被限制在宾馆

这题OG出的时候估计忘了考虑逻辑合理性了，对A选项的解释也是莫名其妙，要知道后面是instead of而不是instead，怎么可能会有members of jury行使confine的歧义呢。。

We can't use "instead of" because the verb following it is not parallel with "to go home", so ABC are ruled out.
"confinement" is a noun so it's not parallel.
In E, "be confined" means "to be confined", and it's parallel with "to go home". Also, "deny to do something" is an idiom, so E is the only correct one.

E is the best answer.
A- incorrect. "instead of" should combine with an "-Ing" form, not with an infinitive. Also, the phrase, "rather than" is more suitable here because it signifies preference of one thing over another.
B-: incorrect. "instead of" with "confined to" is simply unidiomatic.
C- Wordier. Moreover, the use of "which" is incorrect as it modifies the wrong word "under" instead of modifying the "motion".
D- Unidiomatic: "rather than confinement"
E: The most concise and grammatically correct answer. Also, it uses the Subjunctive Mood which is perfectly suitable in this context.

最好把 a motion to allow...换成 a motion which allow 来处理，这样的话， E选项就是 JB denied a motion which allow..sb to do sth.. rather than (to ) be confiened to a hotel, which 后面的都是修饰这个motion 的内容

按照LZ的理解-to confine修饰motion. 如果这样处理A选项的话，句子的结构就变成 JB denied a motion which allow.... instead of which ..., 这样这个motion的内容有就冲突：到底是限制人身自由还是不限制呢？要知道which修饰的是同样一个motion, 其内容不能矛盾；这和rather than 还是 instead of无关；

觉得OG的解释是对的！
A中 to allow members of the jury to go home instead of to confine them in hotel
OG 解释的意思是：allow to go home 和allow to confine them in hotel平行，这么一来就有members of jury行使confine的歧义了
因为go home 的主语是陪审团成员，那么相应的，confine them的主语也是陪审团成员
我比较疑惑的是为什么to confine 不能和to allow平行
如果A选项改成to allow members of the jury to go home rather than to confine them to a hotel,是否正确呢？？
请NN解答！！！

觉得OG的解释是对的！
A中 to allow members of the jury to go home instead of to confine them in hotel
OG 解释的意思是：allow to go home 和allow to confine them in hotel平行，这么一来就有members of jury行使confine的歧义了
因为go home 的主语是陪审团成员，那么相应的，confine them的主语也是陪审团成员
我比较疑惑的是为什么to confine 不能和to allow平行
如果A选项改成to allow members of the jury to go home rather than to confine them to a hotel,是否正确呢？？

dear ls...我只看了你寫的，木有看完整的題，但是我覺得A是一看就錯的

。

instead of和rather than用法區別

（1）Instead of是prep phrase，X instead of Y要求X和Y都要是平行的nouns（pronouns/gerunds）

（2）Rather than是conj，X rather than Y要求X和Y都要是平行的words/phrases/clauses【basically anything】

l當X和Y均是平行的nouns，instead of和rather than都是正確的！

l注意：無論是instead of還是rather than，前後兩部份內容都要求平行！

所以instead of後面加to confine是不對的。hope it helpsXD
