89、[Claim] Many problems of modern society cannot be solved by laws and
the legal system. [Reason] Laws cannot change what is in people's hearts
or minds.
[Write a response in which you discuss the extent to which you agree or
disagree with the claim and the reason on which that claim is based.]
Does many problems of modern society cannot be solved by laws and the legal system? The writer maintains that because of the inability of law to change what is already in people's mind or hearts.However, I admit sometimes it is true that law couldn't address some problem.But I firmly contend law is still in effect that it can solve considerable problem and partly disagree with the reasoning of the writers' proposition.Here are some compelling reasons that illustrate strongly my viewpoint.
Actually, there are some kind of situation that cannot be solve by laws.Because of its special complexity. For instance, if a account has found a great opportunity to transfer money from the government to himself with no one is watching and no evidence of computer could be found, and if he is not that upright, he would do to steal the money because he is entranced by the money.Can his self-conscience wake him up? Perhaps not.Because laws cannot change what is already in people's mind just as the voracious account's.
However, in some situations, laws do can change what is in people's mind and heart. Because when law become something connected with or infused to ethics, people's mind would be changed. So the key for a law to change people's mind is whether the law is infused with ethics -the general norm that society is fit with.For example, rape is a felony in modern society, but in Roman long long ago.It is not a serious felony.Because war is of great amount.And it usually happens when the warriors came home find their wife has been grasped by other warriors of other country.And even their wives called them to leave for another castle to have wars with another country to get other's wives. So that ethics at that time didn't regard such thing as a extreme evil. On the contrary,when ethic norm is influenced by law,then the effect of law would be put into effect. For instance, the slave is not widely condemned until the law against slaves had been effective. So it is true that laws can change what is inside people's mind.
Even admitting that laws cannot change what is in people's mind or hearts, many problem can still be solved by laws. Because law has its undeniable power and it is obligatory which everyone should follow the rules and behave according to it. For example, even there are some many people that consider about robbing a bank, most of them would not actually to do it. Because it is too dangerous when they are punished by law,usually it would be a whole-life-immure, even if they still dream about robbing.And it's the power of law to stop people from practicing the illegal behavior.
In conclusion, I maintain law is still in effect that it can solve considerable problem. |
