标题: issue 65 [打印本页] 作者: byhdhr123 时间: 2012-11-23 22:04 标题: issue 65 65 Every individual in a society has a responsibility to obey just laws and to disobey and resist unjust laws. 每个社会成员都有责任遵守公正的法律,违抗不公平的法律。 The claim just says that people have rights and responsibilities to obey just laws and disobey unjust ones.I partially disagree with the claim.I concede that individuals do have rights to disobey unjust laws to some extent,but of the complexity of law and to sustain a soceity's stability,I have some own concerns. Admittedly,citizens do have the obligations of obeying just laws and some rights to dismiss unjust ones.For obeying just ones, it is easy to understand to people,for a just law appeals to one's ideal of a fair nation.Thus,individuals not only are obligated in obeying them,but also have a strong willing to stick to it.And on the contrary,disobeying some flawed and unjust law is also a individual's right.Disobeying is the way of progress of humankind.Every person,born to be free and equal,is an entity longing for justice,not a slave to the law.If majority of its people are dismissing the laws in nation,it is not a terrible uprising or rebellion as government will call it,on the contrary,it is the inevitable way of progress of the nation. But just as mentioned,only when majority of its people are disobeying laws is it a right and responsibility for every individual.If we look deeply into the nature of laws,it is more complex than thought.Laws are made of human,unlike nature's laws,which can be applied to everywhere.Law is the reflection of a nation's ruling class's interest.No matter how democratic and fair a nation claims to be,there will always be conformist and dissenters.So a law is just "conditionally fair",never a"absolutely fair".Thus,the laws can be seen as a tool that protects majority of a nation's people.Whether a law is just or not is not judged by any specific individual,but by the mainstream of the society.If everyone in the society can decide which law is just and another is not then just obeys "fair ones",it is anarchism or a degradation of a nation ,rather than a progress of the nation. Moreover,now that they are laws,it is its function that to bring stability of the country.If a law is not implemented equally or implemented differently to different person,so where is the dignity of laws and why should people revere it ?It is just like soldiers must obey their orders from their commander.If soldiers just obey what they think is right,do this army have the ability to fight and defend the nation?When a law is disobeyed by its people randomly, the society will sure lose its stability and become turmoiled in the end. So to sum up,disobeying unjust law is the right of everyone,but each individual can not judge the law by their point of view,and then breach it randomly.it is stability of the nation that is in the place.To randomly dismiss these "unjust law" can be disastrous and harmful to the whole nation and its people in feedback. 听说这个issue是最难的,是这样的吗?作者: 普渡哥 时间: 2012-11-24 12:15

这个题目建议LZ能跳出法律正义与否本身的讨论,法律作为一种规范本身就是肯定对某些人是公平的而对另外些人是不公平的,而不存在绝对的公平或者不公平,这是第一点,其次,法律即使有不妥的地方,但所人都必须遵守,而不是有选择性的遵守,否则法律都会成为一纸空文,而不妥的地方只能通过合法的途径来纠正而不是不遵守,再就是,你最好不要拿我们政治课中的观点,比如法律是统治阶级的意志体现。这题目本身不难,但是很经典。作者: byhdhr123 时间: 2012-11-25 12:17
个人觉得从法律的本质讲起,才能让人明白为什么法律只是相对公平,因为人们都会下意识的认为,法律是对每个人都公平的。而法律是统治阶级的意志体现,也没有问题啊。作者: 竹林中人 时间: 2012-11-25 13:10
