1.motion作“会上的提议”之意时，固定结构要求是：motion to do sth或motion that，不可用doing。
2.对于本文平行的考虑：allow和confine并不能成为一对对比。confine和go home才是对比。选E, 因为句子补全就是：motion to allow members to go home...rather than (members) be confined，逻辑意思很完整，法官否定了一项动议，就是允许陪审团成员每天回家而不是将他们的地方禁闭在hotel里。（而且不就是to do rather than do的使用方法吗）

instead of

of is a preposition and must be followed by noun

to confine is not acting as a noun here （ but confining could be construed as a noun， the simple gerund）

allow he confine所描述的词不一样，allow是描述motion...confine是描述members of jury. 所以跟go to home是并列关系，因为go to home也是指members of jury. 之所以用be confined,是“被限制在”的意思。整句话的意思是：法官否定了一个提案，（什么提案呢），一个让陪审团人员晚上不用再被限制在旅店了，而是允许他们回家的提案。

instead of 后面要接名词形式，所以A是不对的，E选项中rather than就可以做到前后平行了。
