我们来看看美国作家,哲学家,《瓦尔登湖》的作者梭罗的观点: Henry David Thoreau: “Under a government which imprisons unjustly, the true place for a just man is also a prison. ". 显然,他认为值得为了良知而违法,甚至去坐牢。当然我们不能只是因为一个人的名气和他的慷慨言辞而接受他的观点。且看他对这个观点的分析。在他的《论公民的不服从》中,他写道:“要么把所有正直的人都投入监狱,要么放弃战争与奴隶制,如果要在这二者之间做出选择的话,州政府会毫不犹豫地做出选择。如果今年有一千人不交税,那不是暴烈、血腥的举动,但是若交税则不然。那是使政府得以施展暴行,让无辜的人流血。如果税务官或其它政府官员问我,正如有位官员问我的那样,“那么,我怎么办呢?”我的回答是,“如果你真希望做什么的话,那你就辞职。”如果臣民拒绝效忠,官员辞职,那么革命就成功了。即使假定这会导致流血的话,难道当良心受伤害的时候就不流血吗?从良心的创伤里流出的是人的气概和永生,将使他永世沉沦于死亡之中。”
另一类人的质疑是,法律是神圣而严肃的,任何形式的破坏都会造成社会的动乱。事实的确如此吗?我们来看看Martin Luther King的观点: King argued that we should break it openly: "An individual who breaks a law that conscience tells him is unjust and who willingly accepts the penalty of imprisonment in order to arouse the conscience of the community over its injustice, is in reality expressing the highest respect for the law". 可见,他也认为对抗“恶法”所付出的代价是值得的。
