查阅OG解释


The predicate has neverbeen applied refers to a span of time, from the writing of the Constitutionto the present, rather than to a past event (as was does), and the phrase is required indicates that the provision still applies.


而A则表示对于一个过去从来没有被实施过的规则，congress从过去一直到现在都。。。就不能表达出该题目原来的意思了

我的理解是：
choiceE时态：has been到现在还未applied，is现在Congress被要求…时间轴连起来了

choiceA的时间轴是:过去没有applied，过去到现在这段时间是否applied未知；从过去到现在一直被要求，时间轴虽然能连起来，但是illogical.不如E合理
