D项与doctor的intention无关:所有病人都知道risk,并不能说明doctor没有刻意欺骗部分病人,明知道他们不适合手术,却还是说服他们接受。

E项与doctor的intention有关:如果doctor在手术前并不知道4个病人中哪个会手术失败,即medically indistinguishable,所以会让4个病人都做手术,虽然只有三个人的可以成功。如此一来,医生在手术前没有欺骗病人的行为。
