by doing 结构和because结构都是表因果关系的，in 不能表示这个逻辑关系,排除C failure是抽象名词，抽象名词优先有动词 且by dong 结构优与because of 结构，becauese of 加较短的名词短语，否则会破坏句子结构

accused the bank of engaging in deceptive business practices 后面跟着的就要说明是如何欺骗，而不是要说什么原因。所以用 because 就很不妥
