agree with A
C中with用的不好， a provision for penalties是包含在agreement里面的，而C的意思是有 a provision for penalties才能sign agreement

同意A，另外，until相当于一个条件句其中用现在时。

我觉得"包括不包括"的问题不是很严重(2楼所述),我个人认为关键是be signed 这里的问题
