我觉得deal是可数名词啊，所以优先把用were排除了选B。而且A连签约双方都不清楚。NN们讨论下正确答案是什么？

个人拙见，选C

I would choose A.

here "were" is used instead of "was" is 虚拟语气.

In C. We don't know what "them" refers to.

我第2次做时又选对了。谢谢楼上的指点，现在连WERE也理解了。另外B还有个问题是SIGN没有用过去试。

觉得的 A: “。。。。 that includes a provision for penalties if the deal were。。。”

修饰 a merger agreement 有一点fragment

I prefer A.

"that includes a provision ... " modifies "agreement".

In choice B and C, if "they" and "them" refer to "investors", there is a logic error. The agreement should not be signed by Investors. It should be signed between the Investors party and the Bank.
